Terms of Service

Please read these Terms of Service ("Terms") carefully before using pm previewer ("Service"), operated by pm previewer LLC ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. You confirm that you are at least 18 years old and that you are located in the United States. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms and that the organization is established in the United States. If you do not agree, you may not use the platform.

2. Description of Service

pm previewer is a technology platform that facilitates the collection, organization, and analysis of property-related information, including photographs, survey responses, and third-party data. The platform is intended to assist property managers and authorized users in making informed decisions but does not provide professional appraisals, inspections, or guarantees of property condition.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Billing

Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees as described at the time of purchase. Subscriptions renew automatically at the end of each billing cycle unless you cancel or pause before the renewal date. You may cancel or pause your subscription at any time from your account settings. No refunds will be issued for partial billing periods.

5. Free Trial

We may offer a free trial that includes a limited number of reports. Trial accounts are subject to the same Terms. We reserve the right to modify or discontinue the trial offering at any time.

6. Acceptable Use

The Service is designed for property managers, landlords, and real estate professionals to collect property survey data, generate preview reports, and manage property documentation. You agree to use the Service only for its intended purpose.

6.1 Prohibited Content

You may not upload, submit, or transmit any content that:

  • Is fraudulent, misleading, or intentionally inaccurate
  • Infringes on the intellectual property rights of others
  • Contains malware, viruses, or other harmful code
  • Includes personal information of individuals without their consent
  • Is defamatory, harassing, threatening, or discriminatory
  • Violates any applicable law or regulation
  • Contains explicit, obscene, or otherwise objectionable material unrelated to property documentation

6.2 Prohibited Activities

You may not use the Service to:

  • Create reports for properties you do not have a legitimate business interest in
  • Collect personal information from survey respondents for purposes unrelated to property management
  • Send survey requests as unsolicited communications (spam)
  • Circumvent usage limits, rate limits, or access controls
  • Attempt to access another user's account or organization data
  • Use automated tools (bots, scrapers) to interact with the Service without authorization
  • Reverse engineer, decompile, or extract source code from the Service
  • Resell, redistribute, or sublicense access to the Service without written permission
  • Interfere with the performance, availability, or security of the Service

6.3 Photo and Data Standards

Photos and data submitted through surveys should:

  • Accurately represent the current condition of the property
  • Be taken at or near the time of the survey (not reused from prior inspections unless disclosed)
  • Not be digitally altered to misrepresent property conditions
  • Not contain identifiable individuals without their knowledge

6.4 API Usage

If you use the pm previewer API, you must:

  • Respect rate limits and usage quotas
  • Keep API keys confidential and not share them publicly
  • Not use the API to build a competing service
  • Include proper error handling and not retry failed requests excessively

6.5 Enforcement

We reserve the right to investigate and respond to violations of this policy. Actions we may take include issuing a warning, temporarily suspending your account, permanently terminating your account, removing content that violates this policy, or reporting illegal activity to law enforcement. We will attempt to notify you before taking action, except where immediate action is necessary to protect the Service or other users.

7. Intellectual Property

The Service, including its design, code, features, and branding, is owned by pm previewer and protected by applicable intellectual property laws. You retain ownership of any content you upload to the Service. By uploading content, you grant us a limited license to process and store that content solely for the purpose of providing the Service.

8. AI-Generated Content

The Service utilizes artificial intelligence and machine learning technologies to analyze photographs and property data, and to provide automated support assistance through an AI help chat feature. While these AI-powered features are performed with high confidence, they are not guaranteed to be 100% accurate. All data, scores, annotations, and insights provided by pm previewer, including AI-generated analysis and help chat responses, should be independently reviewed and verified by the user before any decisions are made. AI-generated content is provided for informational purposes only and should not be considered a substitute for professional property inspection or assessment. Responses from the AI help assistant are informational only and may not reflect the most current system state. For account-specific actions or billing issues, contact support directly.

9. Third-Party Data

The Service may incorporate data from third-party sources to enrich reports. The platform relies in part on data submitted by third parties (including survey respondents) and automated analysis tools. pm previewer makes no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any data or analysis provided through the platform and is not responsible for any decisions made based on such data.

10. User Responsibility and Decision-Making

Any decision made by any user of the platform, including but not limited to property managers, lenders, insurers, investors, or any other party, as a result of the data, reports, analysis, or information provided by pm previewer is made at the sole discretion of that user. pm previewer is not responsible in any way for how the data is used, interpreted, or acted upon. Users assume full responsibility for all decisions and actions taken based on information obtained through the platform.

11. No Professional Advice

Nothing provided by pm previewer constitutes professional advice, including but not limited to legal, financial, insurance, appraisal, or real estate advice. Users should consult qualified professionals before making significant property-related decisions.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

13. Limitation of Liability

To the fullest extent permitted by applicable law, pm previewer, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with (a) your use of or inability to use the platform; (b) any errors, inaccuracies, or omissions in data, reports, or AI-generated analysis; (c) any unauthorized access to or use of your information; (d) any decisions made by any party based on information or analysis provided through the platform; or (e) any other matter relating to the platform or its services. Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Disclaimer of Warranties

The platform and all associated services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. pm previewer does not warrant that the platform will be uninterrupted, error-free, or secure, or that any defects will be corrected.

15. Indemnification

You agree to indemnify, defend, and hold harmless pm previewer, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with (a) your use of the platform; (b) your breach of these terms; (c) any decisions or actions taken based on data obtained through the platform; or (d) your violation of any applicable law or regulation.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

17. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

18. Binding Arbitration and Class Action Waiver

18.1 Agreement to Arbitrate

You and pm previewer agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, "Disputes") will be resolved through binding individual arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act governs the interpretation and enforcement of this Section.

18.2 Arbitration Procedure

The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration will be conducted by a single arbitrator. The arbitration may be conducted in person, by document submission, by telephone, or online, at the election of the party initiating arbitration. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

18.3 Class Action Waiver

YOU AND PM PREVIEWER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding. If a court decides that applicable law precludes enforcement of any of this paragraph's limitations as to a particular claim for relief, then that claim (and only that claim) must be severed from the arbitration and may be brought in court.

18.4 30-Day Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to support@pmpreviewer.com within thirty (30) days of first accepting these Terms. Your notice must include your full name, account email, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provisions of these Terms.

18.5 Exceptions

Notwithstanding the foregoing, either party may bring an action in court to (a) seek injunctive or other equitable relief to protect intellectual property rights, or (b) recover unpaid fees owed.

19. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Subject to Section 18 (Binding Arbitration and Class Action Waiver), any dispute, claim, or controversy arising out of or relating to these Terms that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of such courts.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms constitute the entire agreement between you and pm previewer with respect to the subject matter hereof and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
